Terms of Service

These Terms govern your use of Holakare, OpenTill, TodayHurts, PigeonTicket, CookedHere, and SockLedger (each, the "Service"), provided by Metric Ton LLC ("Metric Ton," "we," "us"). By creating an account or using a Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Eligibility & accounts
You must be at least 18 to create an account. You're responsible for your account and for keeping your credentials secure. Some Services let the account holder bring in other people — for example PigeonTicket trip members and read-only link recipients, or Holakare caregivers. They take part as non-paying participants under the account holder's plan, and everyone who uses the Service must follow these Terms.
2. Your content & the license you give us
You keep ownership of the content you create or upload ("User Content") — trip ideas and photos, care notes, meal photos and captions, uploaded receipts, and so on. To operate the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to provide the Service to you and the people you share it with (for example, showing a shared PigeonTicket itinerary to trip members, or running a CookedHere meal photo through the parser that structures it). This license ends when you delete the content or your account, except for reasonable backups and as required by law.
You represent that you have the rights to the content you upload and that it doesn't infringe anyone else's rights. See our Copyright / DMCA Policy for reporting infringement.
3. Acceptable use
Don't use the Service to break the law, infringe others' rights, upload malware, harass others, or attempt to disrupt or reverse-engineer the Service. We may remove content or suspend accounts that violate these Terms, and we may terminate repeat infringers.
4. Subscriptions & billing
Where you buy determines who bills you. Holakare is distributed through the Apple App Store and billed by Apple. PigeonTicket is bought directly on the web and billed by Stripe; both are subscriptions that auto-renew until cancelled, and we disclose the price and renewal terms before you buy. OpenTill is different: it's a one-time purchase, not a subscription, sold on Gumroad.
Who is the seller of record depends on the product. For OpenTill, Gumroad is the merchant of record — Gumroad, not Metric Ton, is the seller on your invoice and on your bank statement, calculates and remits any sales tax or VAT, and its own buyer terms govern refunds and chargebacks. For PigeonTicket, Metric Ton is the seller of record: Stripe processes the payment and calculates U.S. sales tax on our behalf, but Metric Ton — not Stripe — is the seller on your invoice and handles refunds directly. Metric Ton licenses the software to you and supports it either way. If you are not sure where to start, contact us and we will point you to the right place.
Cancel an App Store subscription in your Apple account settings — cancelling inside the app alone does not stop Apple billing, which is the most common reason a charge appears after someone thinks they have cancelled. Refunds for App Store purchases are handled under Apple's policy, which we do not control. Cancel a PigeonTicket subscription from your account's subscription settings.
5. Product-specific disclaimers
Health & medical (Holakare, TodayHurts) — Holakare and TodayHurts are not medical devices and do not provide medical advice. The Service is a tool to help you organize care and fitness information. It is not a substitute for professional medical judgment, diagnosis, or treatment, and safety features (such as dose reminders or "safe to take" prompts) are conveniences, not clinical guarantees. Always rely on a qualified healthcare professional and product labeling for medical decisions, and call emergency services in an emergency.
Financial & operational (SockLedger) — SockLedger is not accounting, tax, or financial advice. It is a tool to help you track and organize your own project costs; totals, allocations, forecasts and operational warnings are estimates and conveniences, not professional advice or guarantees of accuracy. Verify figures against your own records and a qualified accountant or tax professional before relying on them for business, tax, or legal decisions.
6. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
7. Limitation of liability
To the fullest extent permitted by law, Metric Ton will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you.
8. Disputes
If something goes wrong, contact us first — most problems are resolved that way, and we would rather fix it than argue about it. If a dispute cannot be resolved informally, it will be heard by the state or federal courts located in Texas, and you and Metric Ton each consent to the jurisdiction of those courts. You may also bring a qualifying claim in small-claims court.
These Terms do not require arbitration, and nothing here waives your right to a jury trial or to participate in a class action.
9. Termination
You can stop using the Service and delete your account at any time. In TodayHurts and Holakare you can do this yourself from Settings; in PigeonTicket, SockLedger and CookedHere, email us and we will delete it for you while self-service deletion is being built. We may suspend or terminate access if you violate these Terms or where required for legal or security reasons. Sections that by their nature should survive — ownership, disclaimers, liability limits and governing law — survive termination.
10. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
11. Changes
We may update these Terms; we will post the new date and, for material changes, notify you in the app or by email before they take effect. Continued use after changes means you accept them.
